5.  Duncan WEIR #5, born 21-Mar-1813 in Muirkirk, Ayrshire, Scotland,[iv] bapt. 02-May-1813 in Muirkirk, Ayrshire, Scotland,4 died 1883.  In a memorandum for council, April 8th,1871, Duncan Weir was appointed as a Justice of the Peace.  In the Pictou County Industrial Census for 1871, Duncan is listed as having the following in River John - Grist Mill, Saw Mill & Shingle making, 4 males, flour, shingles, oat meal & buckwheat; and, a Carding Machine, 3 males, rolls. Notes: (1) The Free Lance, March 5th, 1908 Page (13), Hymen's Doings in Years Gone By, records Duncan's marriage to Janet Smith as being on April 18th, vice May 18th.  Duncan's second marriage was performed by Rev. Geroge Roddick. (2) On the probate records for Duncan, the first entry is July 13th 1883.  Duncan therefore died before this date.

6.  John WIER #6, born 07-May-1815 in Muirkirk, Ayrshire, Scotland,4 bapt. 14-May-1815 in Muirkirk, Ayrshire, Scotland,4 died 30-Mar-1881 in Pine Tree Gut, Pictou Co., NS,[xvii] buried: in Woodburn Cemetery, Pictou Co., NS.[xviii]  At the time of his marriage, John was from Lower Settlement, East River, Pictou Co.  Family stories have it that for the first 6 months of his marriage, his father Allan collected his wages as he was under the age of 21.  In 1842, John and his father Allan purchased land in Pine Tree.

    

     From the Notes of Harold McLellan:  John was the first Weir to settle in Pine Tree.  My father, Gerald McLellan, told me that he remembers his grandfather taking wheat to Mr. Weir's gristmill in Pinetree, 2 miles from Woodburn, and coming home with a bag of flour.  He said that the Weirs have been traced back to Sir Christopher Wren. Notes of Harold McLellan have John's date of death as 30 Apr 1881.

 

     He married Agnes WREN #8, married 01-Dec-1835,[xix] born 1815 in Fall Cross, Scotland,[xx] (daughter of William WREN #3852 and Agnes #3853) died 07-Feb-1877 in Pine Tree Gut, Pictou Co., NS,20 buried: in Woodburn Cemetery, Pictou Co., NS.18

 

     Agnes: At the time of her marriage, Agnes was from East River, Pictou Co., NS.  The Free Lance records her maiden name as WRAN.  Pictou Co. NS Deaths 1875-1877 list surname as RAND vice Wren. All other documentation give name as Wren. Suspect that her death was miss-recorded when the records were transcribed from old documents.  Died at age 61 of Decline.

                      ix.   Hugh Wyndham WEIR #595, born 1855, died 1857.  From the notes of Marjorie (Scott) Taylor a headstone had been made for Wyndham, but it had an error on it and was never put up.

Note:  The Mystery of Andrew Weir.  Andrew Weir continues to be a mystery to this researcher, as I may not have the correct Andrew Weir.  I am confident as to his descendants, however, I have been in contact with another gentleman who claims this Andrew as the son of a William Weir.  I am waiting for a copy of his research and his documentation of his links before I make any decision on who are the parents of Andrew Weir.  The basis of my link of Andrew to Allan Weir is from family stories from the Weirs of Pictou County, NS.  I will keep everyone updated as to the results of this.

     Agnes: The year of birth for Agnes has not yet been determined.  Her obituary from the Pictou Advocate put her Year of birth as 1821; other sources give the years as 1826, 1827 and 1830.

                             William: The Presbyterian Witness, Saturday, January 18, 1873, Vol XXVI, No. 3, p.8 lists their marriage as being 9 Jan 1873 in contrast to the Pictou Co., Marriage Records 1864-1906 showing 9 July 1873.

     SUDDEN DEATH - On Monday night of last week a man named James Weir, a native of Renfrewshire, Scotland, dropped dead in the Foord Pit, Albion Mines, from supposed heart disease. Deceased was 57 years of age, and employed as a "travelling boss" in the mine. He leaves a widow and a large family.

9.  Jonathan WEIR #3, born 11-Oct-1824 in Paisley, Scotland,[xlvii] occupation Machinist, died 21-Jan-1893 in Moncton, NB,[xlviii] buried: 23-Jan-1893 in Elmwood Cemetery, Moncton, NB.  The 1871 Census for Moncton NB lists the Moncton Machine Shop with Jonathan Wier as it's proprietor. Jonathan owned and operated the St. John's Foundry.  Timothy Eaton Company later built on the same site and that closed its doors in the 1970's.  He was an elder in the St. John's Presbyterian Church (later United Church), in Moncton, New Brunswick.  Jonathan was a councilman in the St. John's Church and there is a stained glass window there dedicated to his memory.

     Agnes: Place of birth from Westmorland Co., NB Return of Clergyman.  #002772. According to the Daily Times, 1 February 1912 "Many Aged Citizens Passed Away in Jany., Agnes died of cancer of the stomach.

From the U.A., Moncton, NB, 05 June 1872 James Weir, about 9 years of age, son of Jonathan WEIR, prop. of the machine works, Moncton (West. Co.), while bathing Saturday in a creek which runs through the marsh near the bridge over the Petitcodiac River, got into a hole and being beyond his dept and unable to swim, was drowned before assistance could reach him.

 

                             From the St. John Daily Telegraph and Morning Journal, St. John, NB, 14 July 1873. Sad Case of Drowning - A son of Mr. Jonathan Weir, proprietor of the machine works, Moncton, while bathing on Saturday in a stream or creek which runs through the marsh near the bridge over the Petitcodiac River, got into a hole containing about twelve feet of water, and being beyond his depth and unable to swim, was drowned before assistance could reach him.  Dr. Rose was quickly brought to the rescue, but life was found to be extinct.  Much sympathy is felt for the bereaved family.  The lad was aged nine years, and was named James.
