In the Court of Probate,
1874 In the Matter of the Estate of James Weir late
of River John the County of Pictou, Miller deceased Testate.
At a
Court of Probate held at the office of the Judge in the Town of
Pictou on the 19th day of May A. D., 1874.
I, John Gollaw
of River John in
the County of Pictou, Esquire
makeoath and say, that I am one of the Subscribing Witnesses, to the last
Will and Testament of the said James Weir late of River John
in the County of Pictou, deceased; The said Will now hereto annexed, bearing
date the third day of February in the year of Our Lord One
Thousand Eight Hundred and Seventy Four
and that the said Testator executed the said Will on the day of the date thereof, by making his mark at the foot or end thereof, as the
same now appears thereon, in the presence of me and
James McNab the
other subscribed witness thereto, both of us being present at the same time,
and we thereupon attested and subscribed the said Will, in the presence of
the said Testator, and in the presence of each other. I also wrote the said Testators name to the end of the Will at his
requestand had the said Witnessess attested the ?....tion? Hereof as
aforesaid

Last Will and Testament of James Weir, River John Proved and Registered 19th
May 1894 This is the last Will and Testament of James Weir of River John in the
County of Pictou, Miller. I
give and bequeath unto my son James Duncan all that certain lot piece or
parcel of land situate lying and being on the Eastern side of the River John
in the County of Pictou and upon which I now reside. Bounded and described
as follows: ?Viz?. Rounded on the North by lands belonging to John McKay and
the road leading from Welsford Bridge on the East by lands belonging to
Thomas Bigney and on the South by land belonging to Alexander Reid and on
the West by a certain Mill lot belonging to Duncan Weir Excepting and
reserving the Dorow or one third part of the same during the period of the
natural life of my Wife Agnes. To Have and To Hold the said lot piece or
parcel of land above described with the privileges and appurtenances thereto belonging or in anywise appertaining unto him the
said James Duncan at such time as he shall have arrived at the full age of
twenty one years his Heirs and
Assigns to his and their only proper use benefit and behoof from and after
by decease And also the sum of One thousand Dollars currency to be paid unto
or his Heirs by my Executors herein after named out of my personal estate
after my decease. Also I give and bequeath unto my daughter Marie Evaline
the sum of Forty Dollars currency to be paid unto her or her Heirs at such
time as she shall have arrived at the full age of twenty years by my
Executors out of my personal estate after my decease. Also I give and
bequeath unto my daughter Mary E. McKay the sum of Forty Dollars currency to be paid unto her or her heirs at
such times as she shall have arrived at the full age of Twenty one years, by
my Executors out of my personal Estate after my decease. Also I give and
bequeath unto my Daughter Janet Smith the sum of forty Dollars currency to
be paid unto her or her heirs at such time as she shall have arrived at the
full age of Twenty one years by my executors out of my personal Estate after
my decease. Also I give and bequeath unto my daughter Annabell the sum of
Forty Dollars Currency to be paid unto her or her heirs at such time as she
shall have arrived at the full age of Twenty one years by my Executors out
of my personal estate after my decease. Also I give and bequeath unto my
daughter Alfarata Ellen the sum of Forty Dollars currency at such times as
she shall have arrived at the full age of Twenty one years to be paid unto
her or her heirs by my executors out of my personal Estate after my decease. Lastly
I give and bequeath unto Wife Agnes the sum of One thousand Dollars currency
to be paid unto her or her heirs by my Executors out of my personal Estate
after my decease And also the whole residue of my Estate real and personal
all property whatsoever to me belonging or wheresoever found after my
decease and after the payment of my foregoing bequests my just debts funeral
expenses and the expenses of Executing this my last Will and Testament, I
give and bequeath unto my Wife Agnes to be by her fully and freely occupied
possessed and enjoyed. And I do hereby nominate, make, constitute and
appoint David Bigney of River John aforesaid farmer and James R. Langill of
Mill Brook River John aforesaid farmer to be joint Executors of this my last
Will and Testament. I do also hereby wholey dissallow, revoke and disannul
all and every other former Testaments, Wills, Legacies, Bequests and
Executors by me in anywise before named willed and bequeathed ratifying and
confirming this and no other to be my last Will and Testament. In
Witness whereof I have hereunto set my hand and Seal this twenty third day of February in the year of our Lord one thousand Eight hundred and Seventy four. Signed sealed published pronounced and Declared by the said James Weir his as his last Will and Testament in

Probate Court 1876 Estate of James Weir Dec' Petition for Final Settlement
Filed 27 Sept. 1876 In the Probate Court for this County of Pictou 1876. In the matter of the testate of James Weir late of River John deceased Miller. To
the Worshipful James Fogo, Judge of said Court We petition of the undersigned
Respectfully herewith That your
petitions received from the worshipful Court on the nineteenth day of May
A.D. 1874 probate of the will of said deceased, That they
have realized as far as ?...........? all the assets of the said deceased
Estate. That they
are no debts due by the said Estate so far as your petitioners are aware
other than as provided in said will. That your
petitioners are desirous of settling up the said Estate and ?........? your
worshipful Court ?..... ...... .....? according and your petitioners as in
duly bound at Pictou 27 Sep 1876
